Dear Representatives of We The People: Honorable

County Commissioner M. Lee Hasenauer and Honorable

City Councilwoman, Annette Williams:_________________

 

 

This short video is terrifying to watch (3+ minutes) as

a property owner, addressing specific and unconstitutional takings of his property and property  rights at a local Township Board, goes over his three minutes and GETS ARRESTED.  The Board, not unlike the

grim-faced city council we observed at our last pubic meeting,  could hardly wait to cut him off.  They knew, after all, who was boss...

 

Another note of real concern: Councilwoman Broyles who was visibly angry at citizens upsetting the decorum of Roberts' Rules of Order, was shocked that

we would ever think that the City Council would use eminent domain as a way to take property.  They would never do that, she said. Never.

 

Well, Councilwoman Broyles, possibly long after you

leave the dais, PlanCheyenne promises just that.  Recent

case in point in nearby Colorado.  Mr. and Mrs. Andy

Barries may experience an unusual and abrupt discontinuance of their rights to private property ownership at the mere whim of Summit County.  Why?

Private property rights are subservient to the interests

of the collective; this time under the guise of (other people's) 'open space' needs.

 

Look at Article 7 of Form-Based Codes in PlanCheyenne's enforcement muscle aka 'Siamese

Twin", the UDC code and judge for yourselves. 

 

7.1.2.a.1: LAND THAT WILL PERMANENTLY REMAIN

UNDEVELOPED DUE TO SIGNIFICANT OR ENVIRONMENTAL FEATURES.  (Remember, you have to look under the rug to see the dirt; read between the lines, please.)

 

7.1.2.a.2:  Undeveloped or rural and estate areas, either

held for future growth or used for ecological support...

("Ecological support"???).

 

The concept is this: a quality environment is what's important when looking at the Barries' property (or YOUR property), and the community's interests are superior to any detriments to the property owner/developer.  (7.1.2.a: Conceptual Framework and T-Zones.)

 

Are our local representative simply naive, as we

clearly see in the miss-cues of Councilwoman Broyles,

or are they simply choosing to dismiss all the well-grounded arguments of the growing number of citizens who not only show up but stay the course each and every time in their demand of constitutional adherence?

 

Final thought:  Monday and Tuesday the PlanCheyenne

hammer comes down on our heads.  We already know by now collusion has taken place and our elected

representatives have told us, "YOUR TIME, DEAR CITIZENS, IS UP."   ~~~Betty
